Terms of Service

Agreement

These Terms of Service (“Terms”) govern your use of the Pool Map mobile application and poolmap.live (together, the “Services”), operated by Pool Map (“we,” “us,” or “our”).

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

Eligibility

You must be at least 13 years old (or the minimum age required in your region) to use Pool Map. The Services are not directed at children under 13, and we do not knowingly permit such use.

The service

Pool Map helps you discover, map, and share swimming pools, jacuzzis, and similar swim spots. Features may include pool listings, maps, reviews, ratings, favorites, visit logs, check-ins, and community leaderboards.

Pool listings and user content are provided by the community. We do not own or operate the pools shown in the app, and we do not guarantee that any location is open, safe, legal to access, or accurately described.

Accounts

Some features require an account. You agree to provide accurate information and to keep your login credentials secure. You are responsible for activity that occurs under your account.

Your content

You retain ownership of content you submit (such as pool listings, reviews, ratings, and comments). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content in connection with operating and improving the Services.

You represent that your content is lawful, accurate to the best of your knowledge, and does not infringe anyone else’s rights.

Acceptable use

You agree not to:

• Use the Services for any unlawful purpose;
• Harass, threaten, or abuse other users;
• Post spam, misleading pool locations, or deliberately false information;
• Encourage trespassing or unauthorized access to private property;
• Attempt to disrupt, scrape, reverse engineer, or compromise the Services;
• Impersonate another person or misrepresent your affiliation.

We may remove content or suspend accounts that violate these Terms or that we reasonably believe harm the community or the Services.

Safety disclaimer

Swimming and visiting pools involve inherent risks. Pools may be on private property, require membership, have changing hours, or present health and safety hazards. You are solely responsible for verifying access rules, permissions, water quality, and local laws before visiting any location. Use Pool Map at your own risk.

Intellectual property

Pool Map’s name, branding, logo, website design, and app software are owned by us or our licensors and are protected by applicable intellectual property laws. You may not copy, modify, or use our branding without permission.

Termination

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Services. Sections that by their nature should survive termination (such as disclaimers and limitations of liability) will survive.

Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POOL MAP AND ITS DEVELOPERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100), IF APPLICABLE.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

Changes to these terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. Continued use of the Services after changes become effective means you accept the updated Terms.
